Mobicube (the “Service Provider") is responsible for providing the Chat Stories service ("Service") offered through daily subscription, as described in item 4 below and accessible through the website http://aedu.storyclick.com/ (the "Site”). The Service is addressed to all customers, pre-paid and post-paid of DU United Arab Emirates (the “Operator”). All users of the Service ("Users") are subject to the Terms and Conditions of Use ("Terms") below.
By accessing or using the Service, you agree to be associated with these Terms. If you don’t agree with any part of the Terms, you don’t have permission to access the Service.
The Service Provider reserves the right to modify, add and/or change, at any time, the content of these Terms, at its sole discretion, upon notice to the user by SMS message. Any changes, additions and/or amendments shall enter into force upon their publication on the Site or by any other means. No claim with respect to any change of the present Terms and Conditions is enforceable against the Service Provider following the moment at which this change becomes available on the website. Each time the User accesses and/or uses the Service, (s)he acknowledges and accepts the current terms at the time of action. It is recommended that the content of the Terms is regularly checked by the User. The Service Provider may discontinue or restrict the use of the Service to any User at any time upon notice to the User.
3.1 To use the Service, the User must be at least eighteen (18) years of full age or, if lower, the person that owns the SIM card or has express authorization from the SIM card’s owner to use it will be considered the User, regardless of the actual holder of the phone. The Service Provider reserves the right to verify the eligibility of the Users. Incongruencies, inaccurate or outdated information can result on the immediate termination of the User’s account on the Service. 3.2 By subscribing to the service via Web, users accept and understand the complete terms and conditions and agree: 3.2.1 To receive SMS communication on their mobile phones relating to the Service. 3.2.2 To receive SMS communication/advertising offers or from other companies that cooperate with the Service Provider. 3.2.3 The service is subscription based at a daily cost of 3.15 AED, the first 1 day is free. The Service Provider reserves the right to refuse the Service, terminate accounts, remove or edit content, or cancel requests in its sole judgment. 3.3 In the event of dispute regarding the Terms and Conditions of Use, conduct, results, and all other matters relating to the Service, the decision of the Service Provider shall be final and no correspondence or discussion shall be entered into unless otherwise mandated by law.
4.1 To subscribe to the service, the user should provide the requested code received in the broadcast notification. Following that, Users will receive an SMS containing credentials to access the Service. Users will need to follow the URL received over SMS to access the Site. To access the Service, Users will need to authenticate with the credentials received over SMS. Access to the Service through the Site depends on Internet connection and can be used over any connection, including WiFi, 3G and 4G. The Service Provider may also offer the option to users to subscribe through other channels as well, including but not limited to Web, Unstructured Supplementary Service Data (USSD), Interactive Voice Response (IVR) and SAT PUSH where applicable. 4.2 Each participant can subscribe to the service via sending any message to 1546 and subscribing to the service at a cost of 3.15 AED/day. Upon first time successful subscription, users may be offered a free period of full access to the portal for one (1) calendar days (unless the subscriber unsubscribes from the Service) after which the daily charge of 3.15 AED/day will apply. The user will be attempted to be charged daily with the basic price point which equals to 3.15 AED (included VAT). If the charging attempt fails, then the system will attempt to charge the user with the subsets of the basic tariff which are 2.1, 1.05, 0.78, 0.52 AED (included VAT), till an attempt becomes successful. In case a user is charged with a lower tariff and not with the initial 3.15 AED tariff of the service, there will be absolutely no change in the eligibility of the user as to the quality, quantity and duration of the service in comparison to the users charged with the 3.15 AED tariff. Specifically, upon completion of the free period the subscriber will be automatically converted to premium user to be able to continue to use the Service fully. The User authorizes the cost of such subscription to be charged as reported on their phone bill, for post-paid users, or the balance of available recharge for prepaid users. The User subscription will be renewed daily and automatically for equal periods, and the User will be charged the corresponding value, unless the User requests its cancellation, in accordance with the provisions below. 4.3 Each SMS Mobile Content sent to participant from the short code 1546 is free of charge, other than the daily cost of 3.15 AED/day after the free period expires. To promote the Service, the Service Provider may offer at its sole discretion special deals on different Terms and Conditions at any time. In addition, the subscription price may be revised from time to time from the original pricing communicated. Any price change will be disclosed at the time of the subscription to the Service or through other SMS communication in the context of the Service. 4.4 Each User can unsubscribe from the Service and opt-out of the service by sending an SMS with the keyword “CANCEL2” to 1546 (Free of charge). 4.5 If a prepaid User does not have enough charge balance for the collection of the subscription price, access to the Service may be suspended and the User may only return to using the Service upon successful topup. Any costs arising from the use of the data plan, for internet connection through 3G or another to be offered in its place by the User to access the Service, are not included in pricing and therefore will normally be charged by the Operator according to the data plan pricing. Each User is solely responsible for any costs incurred to access the Site through any wireless or other communication service. 4.6 The Service Provider reserves the right at any time to modify, suspend or discontinue, temporarily or permanently, the Service with prior notice to Users. In this case, the user will not be entitled to any compensation and / or refund by the Service Provider.
5.1 The User may use the Service only for lawful and non-commercial purposes. Through registration to and use of the User is granted only a personal, non-transferable, non-exclusive, non-commercial license. Therefore, there will be no transfer of ownership of Content to User. 5.2 The User may not use the Service in any manner that could damage, disable, overburden or impair the servers or networks, or interfere with the use or enjoyment of the Service by any other party. The User may not attempt to gain unauthorized access to the Service, the User accounts, computer systems or computer networks or mobile devices through "hacking", password mining or any other way. 5.3 The User agrees not to use the Service or give permission to a third party, to: • Copy, modify, adapt, translate, or reverse engineer any part of the Service and its contents; • Remove notifications or citations of any copyright, trademark or other proprietary rights notices contained in the Service or any content or other materials available on the Site; • Transmit files that contain viruses, "malware", disabling code, corrupted files or any other similar software or programs that may damage the computer's operation of another party; • Use the Service to deliver ads or unsolicited promotional materials, "spam," pyramid schemes, "current" information or similar forms of advertising or unauthorized solicitation, or "hack" or breach any security measure; • Reformat or reproduce any of the pages that are part of the Site; • Create user accounts by automated means or under false or fraudulent pretenses; or • Collect or store personal data about other users in connection with the prohibited activities described in this item, Without the Service Provider’s written consent. 5.4 The Service Provider may take legal action and make use of any technical device to prevent the violation of this item. If the Service Provider identifies any breach of the above clause, the Service Provider may cancel the User’s access to the Service without notice. 5.5 The services offered by the Service Provider are protected under the current legislation and the unauthorized use of any part of the Service will result in violation of copyright, trademark and / or other intellectual property rights owned by Service Provider or for which it holds permits for commercial use. 5.6 In addition to the above, the Service, and any and all related copyrights are the property of the Service Provider or its affiliates, suppliers, distributors, merchants, licensors or other partners, and are protected by the law.
6.1 The Service Provider may ask the User to provide personal information so that it can have access to all the functions of the Service. By providing this information, the User agrees with the accuracy and updating of the data in the system. The User hereby agrees that personal data supplied when participating in the Service may be used by the Service Provider to monitor participation in the Service, to provide services to Users from time to time and to evaluate Service improvements. The User further acknowledges that, if any information provided by him is untrue, inaccurate, not current or incomplete, the Service Provider shall have the right to terminate the use of the Service, with or without notice. 6.2 In addition to the information required by the User, the Service Provider may automatically receive and record non-personal information from the User's browser while the User accesses the Service. The information collected from Users through the Service may be used for the purposes for which it was provided, enabling access to the Service and the provision of technical assistance by Supplier. Under no circumstances shall the information collected from Users be used for advertising purposes or shared with third parties for any purposes other than the purposes for which it was provided. The Service provides reasonable measures of administrative security, physical and electronic in order to protect the information collected from loss, misuse and fraudulent alteration of personal information. However, by the very nature of the Internet, no data transmission over the medium can be considered absolutely inviolable by third parties acting unlawfully and others form the control established by the Service. 6.3 The User responsible for keeping the confidentiality of their account and password, including, but not limited to, the restriction of access to their computer and/or account. The User with the acceptance of all legal responsibilities by all and any activity or action associated with their account and/or password, being their password associated with our Service or a third-party one. The User should notify the Service Provider immediately after being aware of any security breaches or unauthorized usage of their account.
7.1 The Service may include links to third party websites, including links provided as automated search results. Some of these sites may contain materials that are objectionable, unlawful, or inaccurate. The Service Provider distances itself explicitly from the contents of any websites to which there are direct or indirect links from the Service. The Service Provider does not assume any responsibility for these contents and/or websites nor does The Provider/Operator endorse these third-party sites or services. The providers of the respective sites are responsible for their content. User acknowledges and agree that the Service Provider is not responsible or liable for any content or other materials on these third-party sites. Any dealings that user may have with advertisers found on the websites are between user and the advertiser, and user acknowledge and agree that the Service Provider is not liable for any loss or claim user may have against any advertiser.
8.1 The User warrants that: • he/she will use the Service in accordance with these Terms and all applicable laws and regulations; • he/she will not infringe any intellectual property rights of any third party; and • he/she will duly pay the subscription fees.
9.1 The Service Provider accepts no responsibility whatsoever for, including without limitation, any error, omission, interruption, defect, delay in operation or transmission, communications line failure when it is not under its direct control and execution. 9.2 The Service Provider reserves the right to whenever is deemed necessary to suspend the Service for operational reasons (e.g. for repairs, planned maintenance or upgrades). The Service Provider promises to restore the campaign as soon as possible after any temporary suspension period. 9.3 The Service can include links to third-party websites or services that are not owned or controlled by the Service Provider. The Service Provider does not have control and does not assume any responsibility by the content, privacy policies and practices of third-party websites or services. We do not guarantee the offers of any of these entities/individuals or their websites.
10.1 Users understand and agree that they use the service at their own risk and willingness and have not been coerced in any manner to subscribe in the service. 10.2 The Service Provider makes no warranty, implied or express, that any part of the service will be uninterrupted and error-free. 10.3 The Service Provider is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or Providers, computer equipment, software failure of any email or entry to be received on account of technical problems or traffic congestion on the Internet, telephone lines or at any web site, or any combination thereof, including any injury or damage to entrant's or any other person's computer or mobile telephone related to or resulting from participation or downloading any materials related to the service. 10.4 By using the service, Users agree that no claim relating to such losses or injuries (including special, indirect and consequential losses) shall be asserted against the Service Provider, its parent companies, affiliates, directors, officers, employees or agents from any and all losses, damages, rights, claims and actions of any kind resulting from acceptance or usage of any prize, including without limitation, personal injuries, death and property damage.
11.1 The Service Provider may immediately terminate and/or suspend the provision of Service to the User without notice, if there is a breach of these terms or other use policies related to the Service, as determined at the sole discretion of the Service Provider. In this case the User will not be entitled to any compensation.
12.1 The Service Provider cannot be held responsible for any delay or impossibility of sending or receiving SMS messages because of a technical problem. All the SMS messages will be considered received by the Operator when they are registered in the Service’s IT system and not when they are sent by the User. All the SMS messages will be considered received by the User at the moment they were sent from the Service’s IT system. The Users recognize and accept that the log files of the informatics system of the Service’s IT System is the proof of the date, hour, minute and second of their receiving. 12.2 The Service Provider accepts no responsibility for any incorrect or incomplete registration details that Users may supply as part of the registration for the Service. 12.3 The Service Provider accepts no responsibility for undelivered, lost or delayed SMS or entries nor for any network errors for which there may be delays during peak time. Proof of sending SMS by Users or is not proof of receipt by the Operator. 12.4 Except for force majeure incidents such as disruptions in power supply, the Operator will procure the technical equipment and the needed software for the Service, without taking responsibility for any technical or network failures. Any claim of a User will be resolved by the Service Provider, if it is well-founded, assuring the equality of chances for the User and repairing the prejudice, if possible.
13.1 In case of any disagreement arises, Users can present their complaint to and the issue will be decided in accordance with the laws of the United Arab Emirates and shall be in compliance with Islamic Sharia principles.
